TERMS AND CONDITIONS FOR BEGIN BRIGHT UK

1.  OUR TERMS

 

1.1.  Please note that any mention of ‘Begin Bright’ in these terms and conditions covers all Begin Bright branded classes including Play with Purpose and School Readiness classes.

 

1.2.  All those wishing to attend a Begin Bright class must agree to the terms and conditions set out below. In the unlikely events of a customer failing to abide by the terms and conditions, a customer may be requested to discontinue lessons with Begin Bright. In this instance, Begin Bright will be under no obligation to provide a refund for any outstanding lessons. During the booking process, customers are asked if they agree with the Terms and Condition and wish to proceed. If a booking is received and a customer has indicated ‘No’, Begin Bright reserve the right to cancel the booking and a refund will be provided. 

 

1.3.  What these terms cover. These are the terms and conditions on which we provide Begin Bright classes to you.

 

1.4.  Why you should read them. Please read these terms and conditions carefully before you book our classes. These terms tell you who we are, how we will provide classes to you, how we may change or end the contract, what to do if there is a problem and other important information. If you think that there is a mistake in these terms and conditions, please contact us to discuss.

 

2.  INFORMATION ABOUT US AND HOW TO CONTACT US

 

2.1.  Who we are. We are Cognition Education UK Limited operating as Begin Bright UK. Cognition Education UK Ltd is a company registered in England and Wales. Our company registration number is 092097587 and our registered address is Cognition Education UK Ltd, The St Botolph Building, 138, Houndsditch, London, United Kingdom, EC3A 7AR. Our registered VAT number is VAT no. 250927895.

 

2.2.  How to contact us. You can contact us by telephoning the team at 0161 407 0022 or by writing us at support@beginbright.com.

 

2.3.  How we may contact you. If we have to contact you, we will do so by telephone or by writing to you at the email address or postal address you provided to us when you booked.

 

2.4.  ‘Writing’ includes emails. When we use the words ‘writing’ or ‘written’ in these terms, this includes emails.

 

3.  OUR CONTRACT WITH YOU

 

3.1.  Booking a class

3.1.1.You can make a class booking online at www.beginbright.co.uk.

 

3.1.2.You must provide us with specific personal information in order to book a class with us. Full details of the information required is in our ‘Data Protection and Online Security’ section.

 

3.1.3. To book a child onto one of the Begin Bright classes, you are confirming that you are the parent or guardian of the child you are registering for and have the authority to make the booking.

 

3.1.4. Once your booking is in place you will receive a confirmation email detailing what you have booked, the price, your payment, our cancellation policy, and our Terms & Conditions. You will have access to view your booking and payment online through a link in the confirmation email at which point a contract will come into existence between you and us.   

 

3.1.5. It is your responsibility to set a strong password when you create a Begin Bright booking and account. This should be a confidential password, unique to you, which you should keep safe and secure. Should you forget your password, you can set a new password by selecting ‘I forgot my password!’.

 

3.1.6. All class timetables are correct at time of publishing. If your class time changes, Begin Bright UK will communicate with you.

 

3.1.7. All of our prices include standard rate VAT where applicable.

 

3.2.  Making payment

 

3.2.1.Classes are paid for in advance.

 

3.2.2. Online card payments are accepted as the form of payment for classes and payments should be made on www.beginbright.co.uk. Begin Bright operate the Stripe payment platform as our payment processor and card details are stored securely (see 12.8. under ‘Data Protection and Online Security’).

 

3.2.3. When you make a purchase on www.beginbright.co.uk using Stripe, you can ask Stripe to remember your payment method details such as credit and debit card details. You can make this choice by selecting a checkbox that is displayed in the Stripe Checkout payment screen on www.beginbright.co.uk along with your phone number. If you choose to be remembered, Stripe will remember your email address, phone number and payment method details for future Stripe transactions.  

 

3.2.4. The Begin Bright website is a booking platform that is integrated with Stripe as a payments platform. Our booking platform does not store, even in an encrypted format, any card numbers.

 

3.2.5. Cards accepted are VISA, MASTERCARD, DICOVER, AMERICAN EXPRESS.

 

3.2.6. It is your responsibility to make sure that there are sufficient funds in your account that the card used for purchasing is valid.

 

4.  Lesson changes or cancellations by us

 

4.1.1.In the unlikely event of ‘last minute’ lesson changes or a lesson cancellation by us, you will be notified by us, by text message to your mobile phone, phone call and/or email with as much notice as possible. Begin Bright will not reimburse any expenses incurred by a customer failing to pick us their message.

 

4.1.2. If a lesson is cancelled by Begin Bright, we will offer you either (i) a place at a replacement lesson; or (ii) a refund for the value of the cancelled lesson. 

 

4.1.3. If you are unable to attend the replacement lesson offered to you, you must let us know within 7 days of notification. In this instance you will be given a refund for the value of the cancelled lesson (see 4.1.2.).

 

4.1.4.If your lesson is cancelled part way through, you will only be credited if you were in attendance, and for the part of the lesson that had to be cancelled, on a pro-rata basis.

 

4.1.5. If insufficient children are booked into your class, we reserve the right to cancel the class. In this instance you will be fully credited for any remaining lessons after the cancellation has occurred. We will offer you either (i) an alternative class or (ii) a monetary refund will be given in line with your original payment.

 

5.  Unable to attend a lesson?

 

5.1.1.If you are unable to attend a lesson, please let us know at least 24 hours in advance either by telephoning 0161 407 0022 or by emailing support@beginbright.com. As a goodwill gesture we will offer you the opportunity to attend another class ‘Courtesy Class’ if the same class is running on a different day and spaces are available. If you are unable to attend the replacement offer, no refund will be offered.

 

5.1.2. If you are unable to let us know that you will not be attending a lesson at least 24 hours in advance, we will be unable to provide you with an option to book a ‘Courtesy Class’.

 

5.1.3.Your class payment has reserved your place just for you/your child and if you miss a lesson for any reason, we are unable to refund you. ‘Courtesy Classes’ are a goodwill gesture by Begin Bright and are subject to availability. They have no cash value and no replacements or alternatives can be offered.

 

5.1.4. If, having let us know you are unable to attend your scheduled class, your circumstances change and you are able to attend the class, you must speak to Begin Bright UK by contacting the team on either 0161 207 0022 or support@beginbright.com in case your lesson is now full.

 

5.1.5. Free trial classes are offered by Begin Bright as an opportunity to sample the course content before committing to buying classes. Free trial classes can be cancelled and/or rearranged up to 24 hours in advance of the class taking place. Free trial classes are offered to each customer once and require manual approval by the Begin Bright team. In this instance, your new request for a free trial session will be approved by the Begin Bright team.  

 

5.1.6. A free trial course can only be booked if spaces are available. Class capacity should be updated on the website but if your free trial booking is cancelled due to capacity issues, you will be offered the opportunity to book another class.

 

5.2.  Cancellations Rights

 

5.2.1.Begin Bright UK operates in lines with statutory guidelines and therefore, your statutory rights are not affected. You are entitled to a 14-day cooling-off period and must contact Begin Bright UK on 0161 407 0022 or at support@beginbright.com to initiate this process and receive your refund. If you have attended classes during the 14-day cooling-off period, your refund shall amount to the value of all future classes that you have booked. The cost of classes provided to you during the cooling-off period will be kept by Begin Bright UK.  

 

5.2.2.By enrolling in the Begin Bright classes you are committed to the programme for the specified number of sessions that your booking relates to post the 14-day cooling-off period. Partial or full refunds may be offered at the discretion of the Begin Bright team, depending on individual circumstances, but cannot be guaranteed. We are unable to offer individual refunds if your child is unable to attend a particular class, however we may be able to send class resources to via email, at the discretion of the class teacher, or offer an alternative class (see 5.1.1).

 

5.3.  Covid-19

 

5.3.1.Begin Bright adheres to the Covid-19 policy in place at the venue where classes are held. We ask that parents adhere to the latest guidelines from the UK government when dropping off/picking up children, for example by wearing masks and limiting social contact where possible.

 

5.3.2.Do not attend class if you, your child, or another close contact have symptoms of Covid-19 and follow the latest government guidelines with regards to testing and isolation. Where possible, Begin Bright will seek to offer an alternative ‘courtesy class’, depending on availability.

 

5.3.3. In the event of class cancellation due to a Covid-19 outbreak or staff illness, parents will be contacted individually in order to advise of any available make-up classes or appropriate refunds at the discretion of the Begin Bright team. 

 

5.4.  Changes to our Terms and Conditions

 

5.4.1.We reserve the right to make amendments to our Terms and Conditions at any time to reflect changes in our business or statutory obligations. The new version will be posted on our website and will take effect immediately upon posting. If applicable, these changes will be communicated to all our customers by email. Previous versions of our Terms and Conditions can be requested from support@beginbright.com.

 

5.5.   Behaviour and Responsibilities

 

5.5.1. All children attending the Begin Bright classes must be dropped off by a supervising adult.

 

5.5.2. Parents/Carers must inform the Begin Bright team prior to the start of a class if they have any concerns regarding the child’s health or inability to complete the class.

 

5.5.3.Customers are expected to behave in a civilised manner towards the Begin Bright UK team, venue staff, other venue users and other Begin Bright customers.

 

5.5.4. Begin Bright may, at its own discretion, refuse entry to a customer if it is felt that the customer’s behaviour is unacceptable. Should unacceptable behaviour continue, future Begin Bright classes will be cancelled without refund.

 

5.5.5. Customers accept that at times there will be physical contact between the Begin Bright UK team and their child, which will be carried out in a professional and caring manner.

 

5.5.6. Customers should aim to arrive 5 minutes before the class and leave no more than 5 minutes after the class to ensure change over of classes.

 

5.5.7.The safety and wellbeing of your child or the child in your care is of the upmost importance to Begin Bright. We have a responsibility to report any inappropriate or suspicious behaviour to the relevant authorities.

 

WE DRAW YOUR ATTENTION TO THE CONTENTS OF THE FOLLOWING CLAUSE

6.   Our responsibility to you.

 

6.1.  We do not exclude or limit in any way our liability to you where it would be unlawful to do so. This includes liability for death or personal injury caused by our negligence or the negligence of our employees, agents, or subcontractors, for fraud or fraudulent misrepresentation.

 

6.2.  In the absence of any proven negligence, lack of due diligence or breach of duty by the Begin Bright team, the participation of your child is done so entirely at your own risk.

 

6.3.  Begin Bright will not accept any liability for articles lost, damaged or stolen.

 

6.4.  Begin Bright cannot be held liable for the actions of third parties i.e., non-Begin Bright customers/team members and, therefore, excludes to the fullest extent possible by law, any liability arising from a breach of this section headed ‘Photography’ by any third party. 

 

7.  What to wear

 

7.1.  Begin Bright UK classes may contain activities of messy play or use materials that may stain clothing. Begin Bright UK will not accept liability for articles lost, damaged or stolen (see 6.3) and as a result, we recommend that children wear suitable clothing that may become marked as a result of use of paint, pens, chalk etc.

 

8.  Health and Safety

 

8.1.  You must not bring your child to a Begin Bright class if they have any illness. Please seek medical advice regarding the suitable to return to class in relation to specific health issues. Please advise the Begin Bright team of any class absences as early as possible and at least 24 hours prior to the class taking place so that and alternate class can be offered (see section 5 ‘Unable to attend a lesson?’).

 

8.2.  Resources provided for the use of children in a Begin Bright class will be resources approved and specified for use by appropriate age ranges.

 

8.3.  All Begin Bright UK staff will hold valid DBS certificates.

 

8.4.  To avoid health risks related to allergies, food should not be consumed in Begin Bright classes.


9. Allergies, Medical Conditions and Additional Needs


9.1. Begin Bright UK offer an opportunity to customers to list any known and relevant allergies, medical conditions and/or additional needs that a child may have as part of the booking process. This information is collected to support health and safety and class delivery. It is the responsibility of the customer booking the session to ensure up to date and relevant information is provided during the booking process and prior to any class start if applicable. This information supports the Begin Bright UK team to make changes to planned delivery where appropriate or discuss on a one to one basis if alterations cannot be made. Further communication between Begin Bright UK and the customer may be required to fully understand needs. 

 

10. Photography and Videos

 

10.1. Begin Bright allow parents to take photographs or videos of their children during Begin Bright sessions, provided that no other children/parents are in the photograph. The Begin Bright team will only take photographs or videos of children in Begin Bright classes or using Begin Bright materials if we have received written consent from each parent to confirm that they are happy for their child(ren) to feature in photography.  

10.2. The Begin Bright team will only take photographs or videos of children once express written permission has been gained from parents. 

10.3. Any changes or updates to this policy will be communicated directly with customers at the earliest opportunity.   

10.4. The Begin Bright team may use photographs or videos of children for marketing and promotional purposes, including, but not limited to, Facebook, Instagram, email communications, flyers, brochures and other promotional materials. By consenting to our photography policy, you are agreeing for pictures of your child(ren) to be used in this way. 


11. First Aid


11.1. Begin Bright UK staff are trained in Paediatric First Aid and may be required to administer first aid to your child during a class. As part of the Begin Bright UK booking process, you are asked for your permission to allow for first aid to be administered to your child if required. If you answer ‘No’ to this question during the booking process, Begin Bright UK have the right to cancel your booking and refund your purchase unless your reasons are explained and accepted by the Begin Bright UK team. 

 

12.  Lost property and valuables

 

12.1.  All property left at the Begin Bright venue including but not limited to: car park, entrance, classroom, is left at your own risk. Please make sure that all belongings are collected at the end of each class.

12.2.  Begin Bright is not liable for any property that is left at the venue and any enquiries should be made directly to the venue as per their lost property policies.

 

13.  Teachers

 

13.1.  Whilst we will try to ensure you always have the same teacher in a particular class, we cannot guarantee this as teachers may fall ill, leave, or cancel for personal reasons. On occasion we may also need to have a new teacher join or lead your lesson in order to up-skill and complete their Begin Bright training. The quality of your lesson will in no way be affected by this though.

 

13.2.  Begin Bright teachers are qualified teachers and are qualified in Paediatric First Aid as well as having a valid DBS check. 

 

14.   Data Protection and Online Security

 

14.1.  In order to book a Begin Bright class you must register your details and those of your child with us. This will include your name, mobile, email address, home address, your child’s names, and your child’s date of birth.

 

14.2.  We may share information provided with us to Cognition Education Group and Begin Bright AUS. This is in order to improve our services to you or to contact you by email to let you know of our other services e.g., new courses or online shop.

 

14.3.  You can choose to unsubscribe to marketing emails at any time.

 

14.4.  The names of you or your child/children and their age will be displayed on our class registers in order to be used by a teacher to help tailor our classes to the individual needs of our customers. These registers will be saved securely and only accessible to the Begin Bright team.

 

14.5.  Please be assured that we will not share this data with any other third party other than those required to process your booking or where we are legally required to do so.

 

14.6.  On very rare occasions we may be obliged to disclose your personal information to a third parties:

 

14.6.1.  Where we are legally required to disclose your information.

14.6.2.  To assist fraud protection and minimise credit risk.

14.6.3.  To assist with audit enquiries.

 

14.7.  Your email address will be used to create your ‘Begin Bright’ online account on our website and for class communication. By providing us with an email address you are agreeing to receive communication from us by email.

 

14.8.   Any payment card details saved within our payment system will be held 100% securely by our payment processor ‘Stripe’ who are PCI DSS Level 1 compliant. If you no longer wish for Stripe to remember your payment method details for future Stipe transactions, you may use the Stripe deletion tool  or contact Stripe support to make this request.

 

14.9.  Your privacy and data are of paramount importance to us but unfortunately, the Internet is 100% secure. Any data sent to us electronically is done so entirely at your own risk. Where you have chosen a password to access certain parts of our website, you are responsible for keeping this password confidential.

15.  Emergency Contact Details

 

15.1. Begin Bright UK is a data controller of your personal information. During the booking process we ask for the details of a nominated Emergency Contact for the duration that the relevant child attends our classes. Should Begin Bright UK be unable to reach the nominated Emergency Contact, we may process your personal information as a secondary nominated Emergency Contact without your consent as our ‘legitimate interest’ to ensure Begin Bright UK holds contact information in the event of an emergency.

 

15.2.  Begin Bright UK will only share your information where we are legally obliged to do so or where an emergency situation requires us to do so.  

 

15.3.  In order to book a Begin Bright class, a parent/guardian of the relevant child must register their details and those of the child/children and provide contact information. We will collect the following information and use it as Emergency Contact details:

 

15.3.1.  Name

15.3.2.  Contact Number

15.3.3.  Contact Email

15.3.4.  Contact Address

 

15.4.  As the nominated Emergency Contact, Begin Bright will only use your information to contact you in the event of an emergency, to comply with the law regarding data sharing and to comply with legal obligations around health, safety and wellbeing of children attending our classes.

 

15.5.  Begin Bright will only share this data within the Begin Bright and Cognition Education group.

 

15.6.  Begin Bright will only hold your personal information for the duration that the relevant child for whom you are an Emergency Contact for attends and in a member of Begin Bright, or until we are notified that you are no longer their Emergency Contact by the parent/guardian.

 

15.7.  You are entitled to see the information held about you and you may ask us to make any necessary changes to ensure that it is accurate and kept up to date. If you wish to do this, please contact support@beginbright.com.

16.  Offers and Discounts

 

16.1.  There will be a selection of offers and discounts available to our customers subject to availability.  

 

16.2.  25% discount for early bulk booking. A discount code of BEGINBGRIGHT25 is available for bulk course purchases from 23rd January until the 28th February 2022. This discount code can be applied on bookings for multiple children.

 

17.  Website Information

 

17.1.  The material made available at www.beginbright.co.uk, including materials in linked sites directly or indirectly accessible from this site, are provided ‘as is’, with no warranty of any kind, express or implied. Any reference to linked sites or to third party companies, products or services by name does not constitute or infer its endorsement by Begin Bright. Begin Bright has used all reasonable endeavours to ensure that information provided through this website is accurate at the time of inclusion, however it accepts no liability for any inaccuracies, errors, or omissions in the site. The information available on the site may be incomplete, out of date or inaccurate. Begin Bright reserves the right at any time and without prior notice to make changes and corrections to the material on the site. Begin Bright accepts no liability for any loss or damage of whatsoever nature caused by the use or the inability to use the materials available in this site or any linked site. Begin Bright has taken all reasonable steps to ensure that the Intellectual Property of third parties is not infringed. If, however, you genuinely believe that the material on this site infringes any Intellectual Property rights, please contact Begin Bright directly. 18.   Begin Bright Complaints Procedure

 

18.1.  We hope you will be delighted with our services but if you are at all unhappy, please follow our complaints procedure:

 

18.1.1.  Speak to the Begin Bright teacher or team member to try to resolve the matter to your satisfaction.


18.1.2.  If the response is not satisfactory, please email a written complaint to support@beginbright.com and you should expect to receive a response in 7 working days.  


18.1.3.  If the response from the Begin Bright team is not satisfactory, a written complaint should be submitted for the attention of the Cognition Education UK Limited to the registered address above (see 2.1).

 

19.  Other Important Terms


19.1.1.  You must notify the Begin Bright team prior to class starting if you are aware of any health concerns that may prohibit your child from completing the class.

 

19.1.2.  Your Begin Bright teacher may have downloaded the class register in advance so for late bookings, please come to class prepared to show your booking confirmation email to the Begin Bright team.  

 

19.1.3.  We may transfer this agreement to someone else. We may transfer our rights and obligations under these terms to another organisations.

 

19.1.4.  You need our consent to transfer your rights to someone else. You may only transfer your rights or your obligations under these terms to another person if we agree to this in writing.

 

19.1.5.  Nobody else has any rights under this contract. This contract is between you and us. No other person shall have any rights to enforce any of its terms.

 

19.1.6.  If a court finds part of this contract illegal, the rest will continue in force. Each of the paragraphs of these terms operates separately. If any court or relevant authority decides that any of them are unlawful, the remaining paragraphs will remain in full force and effect.

 

19.1.7.  Even if we delay in enforcing this contract, we can still enforce it later. If we do not insist immediately that you do anything you are required to do under these terms, or if we delay in taking steps against you in respect of your breaking this contract, that will not mean that you do not have to do those things and it will not prevent us taking steps against you at a later date. For example, if you miss a payment and we do not chase you but we continue to provide the products, we can still require you to make the payment at a later date.

 

19.2.  Which laws apply to this contract and where you may bring legal proceedings. These terms are governed by English law, and you can bring legal proceedings in respect of the products in the English courts.
